Terms and conditions
This English version is a courtesy translation. In case of discrepancies, the German version prevails (Deutsch).
§ 1 Scope
These terms apply to the use of the website novascreen.ai and to participation in the NovaScreen AI Film Festival, operated by 21East e.U. By registering an account and/or submitting a film, you accept these terms.
§ 2 Contracting party
The contracting party is 21East e.U., Carminweg 13, A-1210 Vienna (contact details: see the imprint).
§ 3 Submission fee
A processing fee is due for submitting a film; its amount and deadlines are shown on the submission page of the respective edition. The fee covers the administrative effort of reviewing and is non-refundable once paid, including if your film is not selected for the programme. This is common practice in the festival industry. Exceptions apply only in the cases of § 5(4) (cancellation or substantial postponement of the festival).
Right of withdrawal: When submitting, you expressly request that we begin work immediately and acknowledge that your right of withdrawal thereby lapses. The fee becomes due on receipt of payment; only then is the submission complete. We delete unpaid submissions after 7 days, at the latest when the submission deadline passes.
Voucher codes: Voucher codes are valid only while the respective allocation lasts and only with a confirmed email address. Each code can be used once per account; at most one free submission per account is possible. Codes are not transferable, have no cash value and cannot be applied retroactively. In case of misuse, for example via several accounts, the submissions concerned may be disqualified.
§ 4 Selection procedure
Whether a submitted film is included in the programme is at the sole discretion of the jury or the festival management. There is no legal entitlement to selection, screening or an award, regardless of whether the submission fee has been paid.
§ 5 Dates, programme and schedule
(1) All dates that we state on the website, in the festival rules or in communications reflect the current plan. This applies in particular to the start and end of the submission period, the Early Bird and regular deadlines, the notification of the selection, and the date and place of the screenings and the awards ceremony. The same applies to the programme and schedule of the festival.
(2) We may change dates, programme and schedule for objective reasons, provided this is reasonable for you. Objective reasons include in particular the availability of venues, official requirements, safety or health reasons, the absence of contributors, technical reasons, and the number or quality of submissions.
(3) We announce changes on the website. For significant changes, such as postponing a deadline or the screening date or changing the venue, we also inform you by email at the address stored in your account, provided you have already submitted a film. A submission deadline that is already running is only extended, never shortened.
(4) If the festival is cancelled altogether, we refund submission fees already paid. If the screening date is postponed by more than 30 days or moved to a place outside Vienna, you can withdraw your submission by email within 14 days of our notice; in that case we refund the submission fee.
(5) In the case of permitted changes under paragraph 2, there are no claims for reimbursement of travel, accommodation or cancellation costs. Our liability under § 8 and your statutory rights remain unaffected.
§ 6 Account and login details
An account is required to submit. You are obliged to keep your login details confidential and to inform us immediately of any misuse of your account.
§ 7 Payment processing
Payments are processed by the payment service provider Mollie B.V. Its own terms of use for the payment process apply in addition.
§ 8 Liability
We accept no liability for the accuracy of the information provided by submitters. We give no guarantee for the availability of externally linked screeners (e.g. on Vimeo/YouTube). Otherwise we are liable only for intent and gross negligence, to the extent permitted by law.
§ 9 Changes to these terms
We reserve the right to amend these terms for future editions. For a submission that is already in progress, the terms in force at the time of submission apply.
§ 10 Governing law, jurisdiction
Austrian law applies, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods. For disputes with businesses, the court responsible for 1210 Vienna is agreed, to the extent permitted by law. Mandatory consumer rights remain unaffected.
§ 11 Severability
Should individual provisions of these terms be invalid, the validity of the remaining provisions remains unaffected.
